\u26a1 PLN 4.8 billion to reduce energy prices for energy-intensive industries \u2013 we know the assumptions of the new draft law
\nA draft bill on providing support for reducing energy prices for energy-intensive industries (UD459) has appeared on RCL.
\nThis is an instrument that is intended to implement in Poland the mechanism provided for in section 4.5 of the Clean Industrial Deal State Aid Framework (CISAF).
\nThe most important assumptions:
\n\ud83d\udd39 PLN 4.8 billion to support energy-intensive industries
\nThe planned budget of the program is:
\n\u2022 PLN 800 million \u2013 2027.
\n\u2022 PLN 1.6 billion \u2013 2028.
\n\u2022 PLN 1.6 billion \u2013 2029.
\n\u2022 PLN 800 million \u2013 2030.
\n\ud83d\udd39 Electricity cost support
\nThe aid will cover a maximum of 50% of the beneficiary's annual electricity consumption.
\nAt the same time, the price of energy covered by aid \u2013 after taking into account the support \u2013 will not be able to fall below EUR 50\/MWh.
\n\ud83d\udd39 The aid will be linked to an investment obligation
\nThe entrepreneur will have to allocate at least 50% of the aid received for new or modernized assets supporting the energy transition and leading to a reduction in the costs of the energy system in the medium and long term.
\n\ud83d\udd39 What investments will be able to be implemented?
\nThe project includes, among others:
\n\u2705 renewable energy installations,
\n\u2705 solutions that increase demand flexibility,
\n\u2705 projects improving energy efficiency,
\n\u2705 electrification of industrial processes.
\nImportantly, investments will be able to be implemented both directly by the beneficiary and with the participation of third parties.
\n\ud83d\udd39 48 months to launch the investment
\nIn principle, the eligible activity being the subject of the investment will have to be launched within 48 months of the granting of aid, with the possibility of extending this period if technically justified.
\n\ud83d\udd39 Tax changes as a source of financing
\nThe project also provides for a temporary increase in CIT for the largest enterprises from specific segments of the energy, fuel and mining sectors, generating revenues above EUR 50 million.
\nThe CIT rate will be:
\n\u27a1\ufe0f 30% in 2027,
\n\u27a1\ufe0f 26% in 2028,
\n\u27a1\ufe0f 23% in 2029,
\n\u27a1\ufe0f from 2030 \u2013 return to the basic rate.
\n\ud83d\udccc The project specifies the rules for cumulation with compensation for indirect CO2 emissions, which limit the possibility of using both mechanisms.<\/p>\n
Now, the key issue will be how the list of beneficiaries, eligible costs, the moment of investment commencement and the detailed rules for cumulating the settlement of the investment obligation will be determined.
