CZ\u0141ONKOSTWO W SP\u00d3\u0141DZIELNIACH MIESZKANIOWYCH<\/strong><\/p>\n

Trybuna\u0142 Konstytucyjny stwierdzi\u0142, \u017ce osoby, kt\u00f3re nie maj\u0105 prawa do lokalu w danej sp\u00f3\u0142dzielni mieszkaniowej, nie mog\u0105 by\u0107 jej cz\u0142onkami. Chodzi o tak zwanych cz\u0142onk\u00f3w oczekuj\u0105cych, czyli takich, kt\u00f3rzy nie maj\u0105 prawa do lokalu, lecz maj\u0105 wp\u0142yw na\u00a0dzia\u0142alno\u015b\u0107 sp\u00f3\u0142dzielni i na przyk\u0142ad na ustalanie op\u0142at dla tych, kt\u00f3rzy prawo do lokalu maj\u0105. Trybuna\u0142 Konstytucyjny uzna\u0142 mi\u0119dzy innymi cz\u0119\u015b\u0107 zaskar\u017conych przepis\u00f3w za\u00a0zgodne z Konstytucj\u0105, a niekt\u00f3re z nich za niezgodne z ustaw\u0105 zasadnicz\u0105. Zdaniem\u00a0Trybuna\u0142u Konstytucyjnego brak prawa cz\u0142onk\u00f3w sp\u00f3\u0142dzielni mieszkaniowych do\u00a0\u015brodk\u00f3w zgromadzonych na funduszu remontowym w razie wyst\u0105pienia ze sp\u00f3\u0142dzielni lub zawi\u0105zania wsp\u00f3lnoty mieszkaniowej jest tak\u017ce niezgodny z konstytucj\u0105. Trybuna\u0142\u00a0zobowi\u0105za\u0142 Sejm mi\u0119dzy innymi do nowelizacji i doprecyzowania przepis\u00f3w ustawy o sp\u00f3\u0142dzielniach mieszkaniowych dotycz\u0105cych sytuacji w\u0142a\u015bcicieli lokali w\u00a0budynkach administrowanych przez sp\u00f3\u0142dzielnie, kt\u00f3rzy nie s\u0105 cz\u0142onkami sp\u00f3\u0142dzielni.
