Stocks – amendments
The amendments to the Act of 16th February 2007 on the Stocks of Crude Oil, Petroleum Products and Natural Gas, as well as on the Rules to be Followed in the Event of Threat to the National Fuel Security or Disruptions on the Petroleum Market (i.e. Journal of Laws of 2016 item 1899 as amended, referred to as “the Act on Stocks”) introduced by the Act of 22nd July 2016 on the amendments to the Act on the Energy Law and some other Acts (Journal of Laws of 2016 item 1165) will enter into force on 1st January 2017.
The amendments to the Act particularly refer to the manufacturers and retailers’ obligation to submit to the President of the Agency for Material Reserve monthly declarations on inter alia the capacity of crude oil and fuels import and the volume of fuel production, as well as the structure of fuel production and import. Declarations shall include the information about the rate of stock fee.
Please, pay your attention to the fact that on 7 December 2016 the President of the Republic of Poland, Andrzej Duda signed the Act of 30 November 2016 on the amendments to the Act on the Energy Law and some other Acts (Journal of Laws of 2016 item 1986, referred to as “the Act of 30th November 2016”) which was published in the Journal of RP Laws on 8th December 2016. The Act of 30th November 2016 also introduces amendments to the Act on Stocks. They are to order and eliminate previous legislative errors and interpretation doubts. The amendments entered into force the day after the promulgation of the Act of 30th November 2016, that is on 9th December 2016.
The entities subject to the Act on Stocks shall get familiar with the above changes immediately. In order to do so we recommend reading the following amending Acts:
